The 10th Circuit Court of Appeals will continue to operate as usual during the lapse in appropriations to resolve cases and controversies as mandated by the Constitution and statutes. The Court will docket new cases, receive documents for filing, address motions and will hear cases on submission and by argument as scheduled. CM/ECF will remain operational and supported at all times.
In particular, all counsel and interested parties should note the January 2019 term of court will proceed as scheduled.
Government attorneys asserting their inability to attend argument or comply with a filing deadline due to the shutdown must file a motion to submit the case on the briefs, continue argument, or suspend the deadline.
Should it become necessary for the court to limit essential activities, an announcement will be posted on this website.
