INCREASES TO THE CRIMINAL JUSTICE ACT EFFECTIVE 1/1/21

The judiciary’s Defender Services account received funding to increase the Criminal Justice Act (CJA) panel attorney hourly rates from $152 to $155 for non-capital work and from $195 to $197 for capital work performed on or after January 1, 2021. Where the appointment of counsel occurred before January 1, 2021, the new hourly compensation rates apply to that portion of services provided on or after the effective date. The waivable case compensation maximum amount for direct criminal representations (non-capital) has also increased from $8,400 to $8,600. The $2,500 amount for other types of appeals has increased to $2,600.
